FHA Training can be the difference between an office struggling to get files approved and making a lot of money by submitting clean files that get approved quickly through underwriting. While FHA is not the overall answer for every broker or loan officer, it is a product that can be used to fit certain borrowers into a loan with a great rate and very good pay for the origination. There are many benefits to having a good FHA training for your office.

If your FHA training is effective, your loan officers, or yourself, can quickly do an evaluation to know whether FHA is a better choice for your client than a conventional mortgage. Although borrowers typically only see the rate difference, the difference in MI (if it is needed on the conventional mortgage) may make the difference in whether the payment makes sense for the borrower. Not everyone is a good candidate for FHA, and going through an FHA training course and material will help in knowing which is better for the client.

Like conventional mortgages, FHA loans have a loan-to-value cap. Do you know how that is calculated? FHA training will help you know whether a refinance for your client can happen through FHA. FHA has an extra fee that is usually not included on conventional mortgages. Does your office know what that fee is, how it is calculated, and how it affects loan-to-value ratios? If not, FHA training for your loan officers will teach them this and how it can help them making a difference for their borrowers. Currently, FHA Secure offers a chance to help out borrowers who may have a mortgage late or two in recent history. However, not everyone that has a mortgage late will qualify for the FHA Secure program. Knowing these guidelines can help your loan officers and marketers target a broader market for refinancing distressed borrowers.

Finally, if an FHA file does not necessarily fit the standard loan criteria, there are ways to get exceptions through a manual underwriting of the file. These items can take someone with questionable credit or high credit ratios from being rejected to approved. If your loan officers, or yourself, do not know what these pieces of information are, then FHA training for you and your office can help save files headed for the reject pile.

Having proper FHA training will help you, and your office, find more borrowers and get their files approved in a timely manner. FHA training will also help you save files that were destined to be rejected by pointing out the strengths in the loan.

Meridian Mortgage investors were unpleasantly surprised to receive a letter from the K&L Gates law firm demanding that they repay interest and dividends they may have received from their Meridian Mortgage investments (Seattle Times on the web 29 April 2012). A Banks Law Office client received such a letter, which threatened to sue him for the amount of his entire Meridian Mortgage investment unless he agreed to pay approximately $ 90,000 in dividend payments that he received ? and cashed ? in good faith. Banks Law Office is defending him against that claim (US Bankruptcy Court 10-17952). According to the Seattle Times, 182 investors received that letter. Investors should not agree to make any payment until they have consulted with a professional who can explain their rights.

According to investor attorney, Robert S. Banks, Meridian investors may have defenses in response to the Meridian trustee?s demands. Some of the available defenses include:

Statute of Limitations. The claims may be time barred by the applicable statute of limitations. The statutes can be complicated, but under the federal Fraudulent Transfer Act, the trustee can only avoid a transfer that ?was made or incurred on or within 2 years before the date of the filing of the [bankruptcy] petition.? The Meridian petition was filed in July, 2010. Under Washington?s Uniform Fraudulent Transfer Act, which may also apply, the claims against investors must be brought ?within four years after the transfer was made or the obligation was incurred or, if later, within one year after the transfer or obligation was or could reasonably have been discovered by the claimant.? Most of the payments to investors were made more than four years ago. Under the Washington law, then, the question is whether the trustee ?could reasonably have discovered? fraud at Meridian Mortgage more than one year ago. Certain bankruptcy statutes may affect the application of the statutes of limitation.

Pre-Ponzi Scheme Payments. The fraudulent transfer laws only apply to transfers made to investors if the company is acting as a Ponzi scheme. Unless the trustee can prove that payments to you were made while Meridian was operating as a Ponzi scheme, your payments are not subject to any fraudulent transfer claims.

Good Faith Defense. Additionally, many Meridian investors also are entitled to consider and present the ?good faith defense,? which is recognized by Washington law, and says that if an investor acted in good faith and exchanged reasonably equivalent value for their investment and return, they are not subject to the trustee?s clawback.

Banks stressed that no investors should rely on this short article to fully inform them of their rights on a complicated legal matter. Farm Credit Reports First Quarter

Agriculture lender Farm Credit Services of Mid-America announced 2012 first quarter earnings of $ 72.9 million, compared to $ 48.7 million in the same period in 2011. Owned and managed assets surpassed $ 18 billion, a 6.8 percent increase over March, 2011.

Farm Credit?s first quarter performance was directly related to the strong agricultural economy and robust farm land values. ?While farmers are able to pay down debt, we saw an increase in new loan activity, particularly on mortgage loans,? said Bill Johnson, president and chief executive officer. ?For the first quarter, loan closings were up more than 20 percent for farm land purchases and almost 50 percent for consumer mortgages.?

Credit quality of the association?s portfolio was also stable. Adversely classified loans decreased to 3.8 percent of the loan portfolio compared to 3.9 percent at December 31, 2011.

The association?s commitment to rural America remained strong and Johnson sited conversion activity as one example of that commitment. ?Since the beginning of the year, Farm Credit has converted ? or refinanced ? nearly 15,000 customer loans representing more than $ 2.2 billion in volume with a customer interest expense savings of $ 57 million over a three year period. Our fee for conversions is minimal with very little paperwork involved and our customers are often surprised that we can lower their interest rate even on fixed rate loans.?

Another way the association provided value to rural communities was through the availability of long-term fixed rate financing for farms. ?Almost 50 percent of our customers have fixed rate loans of 10 years or longer. In today?s volatile farm environment, one way to ensure that the cost of farmer?s financing remains consistent is through fixed rates.?

Johnson added that the association?s strategic plan calls for continued growth. ?We?ll do that by making certain that our products and programs fit our customers? needs and adapting to the changing demands of a new agriculture marketplace.
